Owner`s Rep Agreement
AIA publishes a number of CM contract documents for agents/consultants who consider the cm advisor who, during the duration of the project, is the owner`s advisor and manages the project in collaboration with the design expert. The standard AIA C132-2009 agreement between the owner and the site manager as a consultant describes the extended level of performance assigned to a CM advisor in accordance with the AIA model documents. As part of the AIA C132-2009 agreement, Cm Advisor makes recommendations to the owner regarding project delivery methods, areas of work and cost estimates. AIA C132-2009, sections 3.2.3, 3.2.4. The CM Advisor provides cost estimation services throughout the project and can advise on construction capacity, material availability, sequencing, the impact of alternative construction methods and other problems. Id., points 3.2.3-3.2.5. The CM can also provide advice on the selection of materials, building systems and equipment and continuously update the project plan and cost estimates. Article 3, Section 3.2.5, 3.2.7. iv) Harmonization of dispute resolution mechanisms. As the prevalence of homeowners representatives increases and extends to additional service areas, litigation involving these advisors becomes more frequent. In the case of a contract with the owner`s representative, it is advisable to ensure that the selection clauses of the court and the coach in the contract with other agreements concluded by the owner with the contractor and the contractor are compliant. It would be inefficient and costly not to be able to file a complaint with a representative of the owner who has an arbitration clause in his contract.
Owners should also understand in their agreements that the owner`s representatives provide services on the basis of rental work and therefore do not acquire ownership of project documents that may be under their control during the project. Due to the nature of their services, owner representatives often collect, manage and manage a significant, if not all, portion of the project information and documents on behalf of the owner. If the project does not use a web-based information management system, the owner may be in the event of a dispute without having access to important project documents. At the other end of the project consulting range is the site manager as a broker/adviser. Like the representative role of the owner, the cm advisor is a paid advisor to the owner and does not directly own construction or construction contracts. However, the level of performance of a cm advisor differs considerably from the representative agreement of a typical owner, as the CM advisor duplicates the design professional and contractor and has the right to make important decisions for the project owner. The role of owner`s representative has become increasingly important and has become an important factor in the success of many projects. The proper structuring of the level of performance by the owner`s representative, the careful verification of qualifications, skills and experience, as well as the establishment of well-structured contracts recognizing the increasing performance risks of these consultants, can make the difference between a successful project or a difficult project.
